Chapter 13.01 GENERAL PLAN ADMINISTRATION
13.01.110 Board of Supervisors’ action.
(a) Public Hearing. After receiving the Planning Commission
recommendation, the Board of Supervisors shall hold at least one public hearing
on the proposed amendment following public notice pursuant to Section 18.10.343.
The public hearing shall be scheduled during the next scheduled consideration of
General Plan Amendments.
(b) Action on Planning Commission Recommendation.
The Board of Supervisors may approve, modify, or disapprove the Planning
Commission’s recommendation, provided that any modification not previously
considered by the Planning Commission shall be referred to the Planning
Commission for a report and recommendation. The Planning Commission is not
required to hold a hearing, and their failure to respond within forty (40) days
shall constitute approval.
(c) Referral. If the Board of Supervisors
initiates a change or addition to the General Plan, it shall first refer the
matter to the Planning Commission for a report. The Planning Commission shall
hold a public hearing after giving notice as required in the above and shall
submit a report to the Board of Supervisors not later than ninety (90) days
after the referral.
(d) Adoption. The Board of Supervisors’ approval
of a General Plan element or amendment shall be in the form of a resolution and
an endorsement placed on the plan. A General Plan Amendment shall be effective
upon passage of the Board of Supervisors’ resolution ordering such an
amendment, except in the case where the amendment affects the Local Coastal
Program, in which case the amendment shall not be effective until approved by
the State Coastal Commission as provided in County Code Chapter 13.03 regarding
