14.29.010 Procedure.

Owners of property legally served by cesspools or septic tanks, or any person authorized in writing to act on an owner's behalf, may request pumping services. Such request shall be made in writing on forms furnished by the department. Upon receipt of the request, a crew will be scheduled to service the cesspool or septic tank. If the director determines that service is required, the contents of the cesspool or septic tank will be removed. The director shall not service a cesspool or septic tank more than once per month during fiscal years ending on or before December 31, 2001, and more than once per quarter during the period beginning January 1, 2002, and ending December 21, 2002, and more than twice per year for the period beginning on or after January 1, 2003. The director may, to preserve public health and safety, service a cesspool or septic tank more frequently, and shall charge a service charge in the amount set forth in the annual budget. 14.29.020 Pumping service charges.

A. Two options are available for pumping charges.

1. Option 1. The following charges are established for pumping services:

a. Initial service charge. Service charges shall be paid in advance at the respective baseyard office of the district overseer before the initial or first pumping of a cesspool or septic tank during each fiscal year or remaining part thereof. Single-family residential dwellings and duplexes, served by a common cesspool or septic tank, shall pay a service charge for each unit served as set forth in the annual budget.

b. Second service charge. Before rendering service, a service charge shall be paid in advance at the respective baseyard office of the district overseer before the second pumping of a cesspool or septic tank during each fiscal year or any remaining part thereof. Single-family dwellings and duplexes, served by a common cesspool or septic tank, shall pay a service charge for each unit served as set forth in the annual budget.

2. Option 2. Customers may elect before the beginning of a fiscal year to be served on a contract basis. A contract shall be obtained and signed at the respective baseyard office of the district overseer prior to the initial pumping of a cesspool or septic tank. The agreement will authorize wastewater system billings every two months beginning July 1 at the appropriate monthly sewer rate as set forth in the annual budget and shall continue until the respective baseyard office is notified in writing to terminate service. Once the contract is terminated, option 2 will no longer be available.

B. Nonpayment of wastewater system charges will result in cancellation of contract and option 1 will be implemented should pumping of cesspool or septic tank be required.

C. Pumping service may be terminated as authorized by section 14.29.050. (Ord. 2968 § 2, 2001: Ord. 2323 § 12 (part), 1994)

14.29.030 Maintenance.

The owner or occupant shall maintain his cesspool or septic tank in a safe, serviceable condition and readily accessible to the department's crew. Failure to exercise reasonable care to minimize the frequency of servicing may result in termination of pumping services as provided in section 14.29.050. (Ord. 2323 § 12 (part), 1994)

14.29.040 Removal of manhole cover.

It shall be the responsibility of the person requesting pumping service for a cesspool or septic tank to remove the manhole cover or other cover prior to receiving any service. Failure to do so will result in no pumping services until cover has been removed. (Ord. 2323 § 12 (part), 1994)

14.29.050 Replacement and rehabilitation.

A. Any cesspool or septic tank requiring more than the number of pumpings provided for in section 14.29.010 shall be rehabilitated or replaced. Upon making such a determination, the director shall notify the owner; and the owner shall rehabilitate or replace the cesspool or septic tank within one hundred twenty days after notification. If the owner elects to rehabilitate the cesspool or septic tank, then low flow fixtures and devices in accord with the plumbing code shall also be installed.

B. If any cesspool or septic tank requires more than the number of pumpings provided for in section 14.29.010 following the initial notification by the director as provided in subsection A of this section, then the owner, upon notification by the director, shall replace the cesspool or septic tank.

C. The director will also notify the state department of health of the status of the cesspool. Failure to take corrective action required by the director may result in termination of pumping services by the department. (Ord. 2885 § 2, 2000: Ord. 2323 § 12 (part), 1994)

14.29.060 Private cesspool/septic haulers.

All private handlers shall comply with all applicable governmental laws, ordinances, and regulations. (Ord. 2323 § 12 (part), 1994)
