14.11.010 Appeals.

Any person aggrieved by a decision or order of the director may file a notice of appeal with the board within thirty calendar days after such decision or order is issued in writing. (Ord. 3446 § 2 (part), 2007)

14.11.020 Filing of appeal; contents of the notice of appeal; the appeal hearing.

Procedures and requirements governing the filing of an appeal, contents of the notice of appeal, and the appeal hearing shall be in accordance with the rules of practice and procedure for the board of water supply. (Ord. 3446 § 2 (part), 2007)

14.11.030 Appeal fee.

A person filing a notice of appeal shall pay a fee as set forth in the annual budget. The fee for filing an appeal may be refunded if the board renders a final decision and order authorizing a refund in full or in part. (Ord. 3577 § 1, 2008: Ord. 3446 § 2 (part), 2007)

14.11.040 Standards of appeal.

The board shall review the director’s decision or order and, by a majority vote of its entire voting membership, may affirm the decision or order, or may reverse or modify the decision or order if the board finds that the substantial rights of the appellant may have been prejudiced because the decision or order is:

A. Based on a clearly erroneous finding of material fact, improper procedure, or erroneous application of the law;

B. Arbitrary or capricious in its application; or

C. A clearly unwarranted abuse of discretion.
