10.76.010 County parking lot adjacent to South High Street in Wailuku.

A. Unless otherwise specifically designated by the director of public works and waste management and appropriately marked, no person shall park in stalls in the County parking lot fronting the County office building at 200 South High Street or in stalls on the Kaohu Street side of the Kalana Pakui Building at 250 South High Street during regular working hours (e.g., between eight a.m. and four p.m.) for a continuous period in excess of one hundred twenty minutes. Access to such parking lot fronting the County office building shall be via Wells Street and egress via Kaohu Street. The director shall have discretion to establish up to fifteen stalls to be designated and marked for parking during regular working hours, as aforesaid, for periods of not more than fifteen minutes. The aforesaid parking restrictions shall not apply on Saturdays, Sundays, and state holidays. 10.76.020 Kamehameha III school parking lot.

A. No driver of any vehicle, except employees of the department of education of the State of Hawaii and others so authorized by the principal of Kamehameha III school, shall park such vehicle between the hours of seven a.m. and four p.m. within the area of the Kamehameha III school parking lot fronting Front Street in Lahaina, County of Maui.

B. Nothing in this section shall be construed to preclude the right of a parent or legal guardian to enter the parking lot to take custody of a student during regular school hours.

C. Restrictions in subsection A of this section shall not apply to Saturdays, Sundays and holidays. (Ord. 413.303 § 1 (part), 2001; Prior code § 10-2.3)

10.76.030 Old Wailuku post office parking lot.

A. Parking stalls in the Old Wailuku post office parking lot, located on Wells Street across from the County office building, shall be allocated as follows: one stall for the department of the prosecuting attorney; one and one-half stalls for disabled persons’ parking; two stalls for the department of liquor control; and eleven stalls for County employees to be designated pursuant to the department of finance’s waiting list.

B. Restrictions in subsection A of this section shall not apply to Saturdays, Sundays and holidays. (Ord. 413.303 § 1 (part), 2001; Ord. 2630 § 1, 1998)

10.76.040 Lahaina Pier.

A. No operator of a motor vehicle nor the owner or user of a trailer, as defined in this title, shall park or stop, except for loading or unloading such vehicle or trailer, on that portion known as the Lahaina Pier.

B. No operator of a motor vehicle nor the owner or user of a trailer, as defined in this title, shall park or stop on that portion of the roadway known as the marginal wharf (that moorings and catwalks) extending from the Lahaina lighthouse to the launching ramp and Canal Street and also within the area adjacent to and east of Canal Street, except in designated parking areas indicated by marked parking stalls or by signs so marked and designated. 10.76.045 Lahaina Luakini Street parking lot.

Within the County parking lot located at Luakini Street between Dickenson Street and Panaewa Street, Lahaina, no vehicle shall park between the hours of two a.m. and four a.m. (Ord. 2656 § 1, 1998)

10.76.050 Lahaina Prison Street parking lot.

A. Within the County parking lot located between Prison Street, Front Street and Luakini Street, Lahaina, a maximum of fourteen bus parking stalls identified by pavement markings or signs shall be provided. No vehicle other than a bus shall be parked in the bus parking stalls between the hours of eight a.m. and ten p.m. each day.

B. Within the County parking lot located between Prison Street, Front Street and Luakini Street, Lahaina, no vehicle shall park for more than three hours at a time.

C. No bus or other vehicle shall park within the County parking lot at the intersection of Front Street and Prison Street, Lahaina, between the hours of two a.m. and four a.m. (Ord. 413.303 § 1 (part), 2001; Ord. 2656 § 2, 1998: Ord. 413.212 § 1, 1988: Ord. 842 § 1, 1976; Ord. 837 § 1, 1976; Ord. 795 § 1, 1974: prior code § 10-2.6)

10.76.055 Lahaina Shaw Street parking lot.

A. Within the County parking lot located at the intersection of Front Street and Shaw Street, Lahaina, a maximum of two bus parking stalls identified by pavement markings or signs shall be provided. No vehicle other than a bus shall be parked in the bus parking stalls.

B. Within the County parking lot located at the intersection of Front Street and Shaw Street, Lahaina, no bus shall park within any standard or compact sized stall as indicated by pavement markings or signs.

C. No bus or other vehicle shall park within the County parking lot located at the intersection of Front Street and Shaw Street, Lahaina, unless the driver and passengers of said vehicle are making use of Malu-Ulu-O-Lele Park.

D. No bus or other vehicle shall park within the County parking lot located at the intersection of Front Street and Shaw Street, Lahaina, between the hours of two a.m. and four a.m. (Ord. 2656 § 3, 1998; Ord. 413.212 § 2, 1988)

10.76.060 Wailuku off-street parking lot.

A. Within the Wailuku off-street parking lot:

1. No owner or operator of any vehicle shall park such vehicle for a continuous period longer than one hundred twenty minutes between the hours of eight a.m. and five p.m. in the following parking stalls:

a. The first row closest to Market Street;

b. The first row closest to Church Street.

2. In the remaining stalls of the Wailuku off-street parking lot, no owner or operator of any vehicle shall park such vehicle for a continuous period longer than twelve hours.

10.76.065 County parking lots, commercial activities prohibited.

A. No person in the business of selling, renting, maintaining, or repairing vehicles shall use any County owned or operated parking lots for storage, holding, or parking of any motor vehicles under such person’s control or belonging to third persons.

B. Each motor vehicle parked in violation of this section shall be considered a separate violation. Each day the violation continues shall be considered a separate violation. (Ord. 413.303 § 1 (part), 2001; Ord. 413.231 § 1, 1990)

10.76.070 County parking lots, parking within designated stalls.

A. The County engineer is authorized and directed to establish, mark and designate individual parking stalls.

B. Wherever parking stalls are so established, marked off and designated, the operator of any vehicle shall park such vehicle completely within a designated stall. (Ord. 413.303 § 1 (part), 2001; Ord. 2656 § 4, 1998)

10.76.075 Makawao Veterans’ Cemetery parking lot.

A. No person shall conduct any activity related to commercial or business enterprises within the parking lot located at the Makawao Veterans’ Cemetery except for those business or commercial activities necessary for cemetery operations or veteran related activities.

B. Any person who violates this section shall be subject to a fine of not less than $100 and not more than $200. (Ord. 413.302 § 1 (part), 2001)

10.76.080 Penalties.

Except as otherwise provided, any person violating the provisions of this chapter shall, upon conviction, be subject to a fine of not less than $50 and not more than $250 for each violation. (Ord. 413.303 § 1 (part), 2001)
