10.60.010 Generally.
Pedestrians shall be subject to traffic-control signals at intersections
and other signalized crossings, as stated in this title; but at all other
places, pedestrians shall be accorded the privileges and shall be subject to the
restrictions as stated in this chapter. (Ord. 413 § 10-15.1,

10.60.020 Right-of-way in crosswalk.
A. When traffic control signals are not in place or not in operation, the
driver of a vehicle shall yield the right-of-way, slowing down or stopping if
need be to so yield, to a pedestrian crossing the roadway within a crosswalk
when the pedestrian is upon the half of the roadway upon which the vehicle is
traveling, or when the pedestrian is approaching so closely from the opposite
half of the roadway as to be in danger.
B. No pedestrian shall suddenly
leave a curb or other place of safety and walk or run into the path of a vehicle
which is so close that it is impossible for the driver to
yield.
C. Whenever any vehicle is stopped at a marked crosswalk or at
any unmarked crosswalk at an intersection to permit a pedestrian to cross the
roadway, the operator of any other vehicle approaching from the rear shall not
overtake and pass such stopped vehicle, nor shall any other vehicle in the
adjacent lane traveling in the same direction as the stopped vehicle pass or
overtake such stopped vehicle. (Ord. 413.144 § 1, 1980; Ord. 413 §

10.60.030 Right-of-way outside crosswalks.
Every pedestrian crossing a roadway at any point other than within a
marked crosswalk or within an unmarked crosswalk at an intersection shall yield
the right-of-way to all vehicles upon the roadway. (Ord. 413 § 10-15.3(1),

10.60.042 Crosswalks established.
A. Wailuku District. Pedestrian crosswalks are established in the Wailuku
district at the following locations:
1. Not less than twelve feet in
width on that portion of Lower Main Street in Wailuku, the center line of the
crosswalk being three hundred feet southwest of the prolongation of the south
curbline of Hoomana Street across Lower Main Street;
2. Not less than
twelve feet in width on that portion across Nakoa Drive along the prolongation
of the southerly shoulder of Kainani Street;
3. Not less than twelve
feet in width on that portion of Puunene Avenue between the northern end of
H.C.&S. garage and the H.C.&S. Co. automotive maintenance repair shop at
Puunene;
4. Not less than ten feet in width on that portion across Mill
Street in Wailuku, approximately two hundred ninety feet east of the junction of
Mill Street and Halewili Drive;
5. Not less than twelve feet in width on
that portion of Kihei Road in Kihei near power pole number 187, approximately
one thousand two hundred feet north of the junction of Kihei Road and Kilohana
Drive;
6. Not less than ten feet on that portion of Kihei Road across
Kalama Park in Kihei, the center line of the crosswalk being opposite power pole
number 149;
7. Not less than eight feet in width on that portion of
Wells Street in Wailuku, approximately one hundred eighty feet from High Street,
in line with the walkway leading to the State Building;
8. Not less than
twelve feet in width on that portion of South Kihei Road, in Kihei, near utility
pole number 97 approximately two hundred feet north of Uwapo
Road;
9. Not less than twelve feet in width on that portion of South
Kihei Road, in Kihei, on the south side of the intersection of South Kihei Road
and Wailana Place;
10. Not less than twelve feet in width on that
portion of South Kihei Road, in Kihei, near Kaonoulu Street fronting Maui Lu
Resort;
11. Not less than twelve feet in width on that portion of South
Kihei Road, in Kihei, near utility pole number 146 fronting Kalama
Park;
12. Not less than twelve feet in width on that portion of South
Kihei Road, in Kihei, near utility pole number 150A fronting Kalama
Park;
13. Not less than twelve feet in width on that portion of South
Kihei Road, across Kamaole Beach Park number one;
14. Not less than
twelve feet in width on that portion of South Kihei Road, in Kihei, near utility
pole number 176A fronting Kamaole Beach Park number two;
15. Not less
than twelve feet in width on that portion of Lipoa Street, in Kihei, west
(makai) of the entrance to Kihei School;
16. Not less than twelve feet
in width on that portion of South Papa Avenue in Kahului, approximately one
hundred feet from the Kihei side of the entrance to Lihikai
School;
17. Not less than twelve feet in width on that portion of South
Papa Avenue in Kahului, approximately seventy-five feet from the Waihee side of
the exit to Lihikai School;
18. Not less than twelve feet in width on
that portion of Maalo Street, in Kahului, approximately two hundred eighty feet
east of South Papa Avenue;
19. Not less than twelve feet in width on
that portion of Kaohu Street along the westerly prolongation of the shoulder
area of Kiele Street;
20. Not less than eight feet in width on that
portion of Kaohu Street four hundred fifty feet west of Waiale
Road;
21. Not less than ten feet in width on that portion of South Kihei
Road, in Kihei, fronting Kamaole Beach Park number two and approximately seven
hundred feet north of Keonekai Road;
22. Not less than ten feet in width
on that portion of South Kihei Road in Kihei, six hundred twenty feet south of
the centerline of Keonekai Road;
23. Not less than ten feet on that
portion of Lower Main Street in Wailuku fronting Hale Makua, approximately six
hundred twenty-five feet southwest from the edge of Mill Street;
24. Not
less than ten feet on that portion of Lower Main Street in Wailuku fronting St.
Anthony Grade School, approximately seven hundred ten feet southwest from the
edge of Mill Street;
25. Not less than ten feet on that portion of Lower
Main Street in Wailuku fronting St. Anthony High School football field,
approximately three hundred seventy-five feet northwest from the edge of Mission
Street;
26. Not less than twelve feet in width on that portion of South
Kihei Road, in Kihei, approximately one thousand three hundred feet south of the
intersection of Alanui Ke Alii Road and South Kihei Road.
B. Lahaina
District. Pedestrian crosswalks are established in the Lahaina district at the
following locations:
1. Not less than twelve feet in width on Front
Street at the entrance to the Puamana Maintenance Shop in Lahaina,
Maui;
2. Not less than twelve feet in width on Lahainaluna Road between
Mill Street and Kuhua Street in Lahaina, Maui;
3. Not less than twelve
feet in width on that portion of Wainee Street, Lahaina, between the Lahaina
Shopping Center and the Lahaina Square, about forty-seven feet from the entrance
to the Lahaina Shopping Center;
4. On that portion of Front Street in
Lahaina, approximately two hundred fifty-eight feet north of Wahie
Lane;
5. On that portion of Lower Honoapiilani Road in Honokowai,
Lahaina, between Honokowai Park and Honokowai Superette;
6. Not less
than ten feet in width on that portion of Front Street in Lahaina, approximately
one hundred thirty feet west of Shaw Street;
7. Not less than eight feet
in width on that portion of Front Street in Lahaina, on the south of Lahaina
Shopping Center driveway, approximately one hundred eighty feet south of
Papalaua Street.
C. Makawao District. Pedestrian crosswalks are
established in the Makawao district at the following locations:
1. Not
less than ten feet in width on that portion of Baldwin Avenue, in Lower Paia,
opposite Dr. Richard Y. Ikeda’s dental office situated in the S. Ikeda
Store building;
2. Not less than twelve feet in width on that portion
across Baldwin Avenue, Upper Paia, the centerline of the crosswalk being one
hundred fifty feet south of the Paia Theater road;
3. Not less than
twelve feet in width at Haiku, from the Catholic Church to the parking
area;
4. Not less than twelve feet in width on that portion of Baldwin
Avenue, in Lower Paia, fronting the U.S. Post Office-Bank of Hawaii
building;
5. Not less than twelve feet in width on that portion of
Baldwin Avenue, in upper Paia fronting on the Doris Todd Memorial Christian Day
School;
6. Not less than twelve feet in width on that portion of Makawao
Avenue in Makawao fronting the Makawao Library;
7. Not less than eight
feet in width on that portion of Haleakala Highway in Pukalani, approximately
forty feet west of Pukalani Street;
8. On that portion of West Kuiaha
Road, approximately one thousand one hundred feet in the makai direction from
the intersection of Haiku Road and West Kuiaha Road;
9. On that portion
of Makawao Avenue fronting Makawao Post Office and being immediately east of the
post office driveway;
10. On that portion of Baldwin Avenue fronting the
Paia Mill Office Building, approximately six hundred fifty feet south of Puakou
Place.
D. Molokai District. Pedestrian crosswalks are established in the
Molokai district at the following locations:
1. Not less than twelve
feet in width on that portion of Ailoa Road fronting Kaunakakai Park in
Kaunakakai, Molokai;
2. Not less than twelve feet in width on the
portion of Puukapele Avenue bounded by Hoolehua Congregational Church and
Molokai High School.
E. Hana District. Pedestrian crosswalks are
established in the Hana district at the following locations:
1. On that
portion of Hana Highway in Hana, between Hasegawa Store and its parking
lot;
2. On that portion of Hana Highway in Hana approximately one
hundred ninety feet south of Keawa Place;
3. On that portion of Hana
Highway in Hana approximately three hundred ten feet south of Keawa
Place;
4. On that portion of Hauoli Street in Hana approximately four
hundred eighty feet east of Hana Highway;
5. On that portion of Hauoli
Street in Hana approximately seven hundred ten feet east of Hana Highway. (Ord.

10.60.050 Use of right half of crosswalk.
Pedestrians shall move, whenever practicable, upon the right half of
crosswalks. (Ord. 413 § 10-15.4, 1965)
10.60.060 Walking along roadways.
A. Where sidewalks are provided, it is unlawful for any pedestrian to walk
along and upon an adjacent roadway.
B. Where sidewalks are not provided,
any pedestrian walking along and upon a roadway shall, when practicable, walk
only on the left side of the roadway or its shoulder facing traffic which may
approach from the opposite direction. (Ord. 2732 § 2, 1998: Ord. 413.22

10.60.070 Blind and crippled pedestrians--Right-of-way.
Except at intersections where the movement of traffic is being regulated
by police officers, the operator of a vehicle shall come to a stop and take such
precautions as may be necessary before proceeding so as to avoid injury to a
crippled pedestrian using crutches, or to a blind or partially blind pedestrian
carrying in full view a cane, white in color, or white with red ends, and
blowing continually a whistle similar to the type of whistle used by traffic

10.60.080 Operators to exercise due care.
Notwithstanding the provisions of this chapter, every operator of a
vehicle shall exercise due care to avoid colliding with any pedestrian upon any
roadway and shall give warning by sounding the horn when necessary and shall
exercise proper precaution upon observing any child or any confused or
incapacitated person upon a roadway. (Ord. 413 § 10-15.7, 1965)
