10.36.010 Generally.

No person shall operate a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions then existing, and where no special hazard exists, the speeds enumerated in this chapter shall be lawful, but any speed in excess of the limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful. This basic rule shall apply to all types of vehicles including vehicle transporting explosives; however, in any zone enumerated in this chapter where the limit exceeds forty-five miles per hour, it shall be prima facie evidence that the speed of a vehicle transporting explosives is not reasonable or prudent and that it is unlawful if the speed of that vehicle is in excess of forty-five miles per hour. 10.36.020 Establishment of speed zones.

Whenever the police department determines upon the basis of an engineering and traffic investigation that any maximum speed limit hereinbefore set forth is greater than is reasonable or safe under the conditions found to exist at any horizontal or vertical curve upon any part of a highway, the police department may post a recommended safe speed thereat which shall serve as a guide to vehicle operators at all times when they are using the highway and which shall be effectively illuminated or reflectorized for visibility at night. 10.36.030 Exceptions.

The speed restrictions set forth in this title shall not apply to an authorized emergency vehicle when responding to an emergency call, or when used in the pursuit of an actual or suspected violator of the law, or when responding to but not upon returning from a fire alarm, and the operator thereof sounds audible signal by bell, siren, or exhaust whistle. This provision shall not relieve the operator of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the street, nor shall it protect the operator of any such vehicle from the consequences of his reckless disregard of the safety of others. 10.36.040 Twenty mile per hour limit--Designated.

No person shall operate a vehicle in excess of twenty miles per hour in any business district and in addition thereto, in the following areas:

A. Wailuku District.

1. Within the following area, beginning at the Government Triangulation Station “LUKE” and running as follows: along a straight line from “LUKE” to the intersection of Waiale Road and Koa Drive; thence along the center of Koa Drive to a point five hundred feet west of High Street; thence along a line five hundred feet west of High Street and parallel thereto to a point five hundred feet south of West Main Street thence along a line five hundred feet south of West Main to the intersection of Main Street and Ilina Street; then along a line running in a northwesterly direction to its intersection with Mokuhau Place; thence along the centerline of Mokuhau Place to a point five hundred feet east of North Market Street; then along a line five hundred feet south of North Market Street, to a point five hundred feet east of Mill Street; then along a line five hundred feet east of Mill Street and parallel thence to its intersection with East Main Street; then along a straight line across the Sandhills to the point of beginning; except South High Street from Keanu Street to Kaohu Street; Mill Street from East Main Street to Market Street; East Main Street from Waiale Road in a northeasterly direction to a point five hundred feet north of its intersection with Mill Street, in which cases a speed of thirty miles per hour will be permitted;

2. The subdivision of Kahului Development Company, Limited, in Kahului, known as “Dream City,” on both sides of Puunene Avenue;

3. The streets in the subdivisions of Kahului Development Company, Limited, in Kahului, known as the Sixth, Seventh, Eighth and Ninth Increments;

4. All of Hanoli Street;

5. All of Kaikoo Street;

6. Waiko Road, beginning from Honoapiilani Highway for a distance of approximately eight hundred feet in the easterly direction;

7. All of Iliili Road, Kihei;

8. All of Kaiau Place, Kihei;

9. All of Puukani Street, Kahului;

10. All of Aoloa Loop, Kahului;

11. All of Leioni Place, Kahului;

12. All of Puukala Place, Kahului;

13. The streets in the Waiehu Heights Subdivision.

B. Lahaina District.

1. The area bounded by Kapunakea Street on the north, Mill Street on the east, Shaw Street on the south and the sea on the west, except Honoapiilani Highway from Prison Street to Papalaua Street;

2. On Front Street in Lahaina from its northern intersection with Honoapiilani Highway to its southern intersection with Honoapiilani Highway;

3. The streets in the Kauaula Subdivision in Lahaina, Maui, Hawaii;

4. All of Kaniau Road;

5. All of Lokai Street;

6. All of Aa Street;

7. All of Kuuipo Street;

8. All of Ainakea Road;

9. All of Malanai Street;

10. All of Malo Street;

11. All of Kalani Road;

12. All of Kekai Road;

13. All of Wahikuli Road;

14. All of Fleming Road;

15. All of Kahoma Street;

16. All of Akeke Place;

17. All of Hamau Place;

18. All of Komohana Place;

19. All of Malolo Place;

20. All of Hiki Place;

21. All of Nahale Place;

2. On Makawao Avenue from a point three hundred feet south of Makani Road to a point three hundred feet north of Makani Road between the hours of seven a.m. and four p.m. on days when school is in session.

D. Lanai District. Within the following areas, beginning at the junction of Kaumalapau Highway and South Awalau Avenue and running as follows: along Kaumalapau Highway to its junction with Queens Street; thence along Queens Street to its junction with Twelfth Street; thence along a straight line one thousand one hundred feet in a northeasterly direction parallel to Twelfth Street to Koa Drive; thence along Koa Drive to the northernmost Mutual Telephone Radio Building; thence along North Awalua Avenue to its junction with Lanai Avenue; thence along South Awalua Avenue to the junction of Fraser Avenue to its junction with Kaumalapau Highway.

E. School Zones. In any school zone between the hours of seven a.m. to four p.m. on school days. The speed limit in school zones for all times other than identified herein shall be governed by Section 10.36.070. 10.36.050 Twenty mile per hour limit--Exception.

The speed limit established by Section 10.36.040 shall not apply to the following areas:

A. Wailuku District.

1. Any portion of Kaahumanu Avenue in Kahului from Kane Street to Hobron Street;

2. Lower Main Street in Wailuku, from its intersection with Mill Street to its intersection with Waiehu Beach Road. (Ord. 413.174 § 1, 1983; Ord. 413 § 10-7.13, 1965)

10.36.060 Twenty-five mile per hour limit.

No person shall operate a vehicle in excess of twenty-five miles per hour in the following areas:

10.36.070 Twenty mile per hour limit.

Except as provided in section 10.36.072 of this chapter, no person shall operate a vehicle in excess of twenty miles per hour in any residential district, and in addition thereto, in the following area: School Zones. In any school zone except between the hours of seven a.m. to six p.m. on school days. 10.36.072 Thirty miles per hour--Residential district exception.

No person shall operate a vehicle in excess of thirty miles per hour in the following areas:

A. Wailuku District.

1. Mill Street in Wailuku, from Lower Main Street to Market Street;

2. Main Street in Wailuku, from Waiale Road in a northeasterly direction to a point five hundred feet north of its intersection with Mill Street;

3. Kanaloa Avenue in Wailuku, from Kaahumanu Avenue to its intersection with Lihi Street;

4. Papa Avenue, from its intersection with Kaahumanu Avenue to its intersection with Puunene Avenue;

5. Lono Avenue, from its intersection with Kaahumanu Avenue to its intersection with Makalii Street;

6. Wakea Avenue, from its intersection with Kaahumanu Avenue to its intersection with Puunene Avenue;

7. Onehee Street, from its intersection with Papa Avenue to its intersection with Wakea Avenue;

8. Hina Avenue, from its intersection with Wakea Avenue to its intersection with Mokapu Street;

9. Kamehameha Avenue, from its intersection with Papa Avenue to its intersection with the Hana Highway;

10. Lower Main Street in Wailuku, from its intersection with Waiale Road to its intersection with Waiehu Beach Road;

11. South Kihei Road in Kihei, from Mokulele Highway to Okolani Drive;

12. Keonekai Road in Kihei, from South Kihei Road to Piilani Highway;

13. Lipoa Street in Kihei, from South Kihei Road to Piilani Highway.

B. Lahaina District.

1. Lahainaluna Road, from the junction of Kelawea Street to Lahainaluna School grounds;

2. Napilihau Street in Napili, from Lower Honoapiilani Road to Honoapiilani Highway;

3. Puukolii Road in Kaanapali, from Honoapiilani Highway to Piihaa Street.

C. Makawao District.

1. Lower Kula Road in Kula, from Kula Highway to Waipoli Road;

2. Lower Kula Road in Kula, from its intersection with Omaopio Road to Pulehuiki Road;

3. Baldwin Avenue, from Hana Highway in Paia to Makawao Avenue in Makawao;

4. Haiku Road in Haiku, from Hana Highway to its intersection with Kokomo Road;

5. Kokomo Road, from Kaupakalua Road in Kokomo to Haiku Road in Haiku;

6. Haliimaile Road in Haliimaile, from Haleakala Highway to Baldwin Avenue;

7. Makawao Avenue in Makawao, from Baldwin Avenue to Haleakala Highway;

8. Makani Road, from Makawao Avenue in Makawao to Haleakala Highway;

9. Kaupakalua Road, from Makawao Avenue to Ulumalu Road;

10. Wailea Alanui Drive in Wailea, from Kilohana Drive to Kaukahi Street;

11. Makena Alanui Drive in Wailea, from Kaukahi Street to Makena Road;

12. Okolani Drive in Wailea, from South Kihei Road to Piilani Highway.

D. Molokai District.

1. Puu Kapele Avenue in Hoolehua, from Lihi Pali Avenue to Haukea Avenue;

2. Lihi Pali Avenue in Hoolehua, from Farrington Avenue to Puukapele Avenue;

3. Moomomi Avenue in Hoolehua, from Puu Kapele Avenue to Maunaloa Highway;

4. Puupeelua Avenue in Hoolehua, from Puu Kapele Avenue to Maunaloa Avenue.

E. Lanai District.

1. Lanai Avenue in Lanai from Kaumalapau Highway to Third Street;

2. Fraser Avenue in Lanai, from Kaumalapau Highway to Third Street;

10.36.080 Thirty-five mile per hour limit.

No person shall operate a vehicle in excess of thirty-five miles per hour on all highways not defined or regulated otherwise in this chapter, and in addition thereto, in the following areas:

A. Lahaina District.

1. Honoapiilani Highway, from a point two thousand eight hundred feet from the intersection of Honoapiilani Highway and Lower Honoapiilani Road at Kanaha for a distance of one thousand seven hundred feet to a point one thousand one hundred feet from the intersection for the Napili-bound traffic.

B. Makawao District.

1. Kula Highway, beginning from its intersection with Kekaulike Avenue to Ulupalakua to the intersection of Piilani Highway and Kanaio Road. (Ord. 413.181 § 1, 1984: Ord. 413.107 § 1(b), 1978: Ord. 413 § 10-7.5, 1965)

10.36.090 Forty-five mile per hour limit.

No person shall operate a vehicle in excess of forty-five miles per hour on the following highways or indicated portions thereof:

A. Wailuku District.

1. Honoapiilani Highway, beginning from the intersection of Keanu Street and South High Street to its intersection with Waiko Road in Waikapu;

2. Kihei Road, beginning from the junction of Honoapiilani Highway at Maalaea to a point one thousand two hundred feet from the intersection of Mokulele Road;

3. Mokulele Highway, beginning at a point .25 mile from the intersection of Mokulele Highway and Kihei Road and extending to a point .5 mile from its intersection with Puunene Highway;

4. Hana Highway, beginning from its intersection with Hobron Street to its intersection with Dairy Road in Kahului and from its intersection with Baldwin Park Road in Paia to a point .2 mile east of the intersection;

5. Kaahumanu Avenue, beginning from the easterly end of Waiale Road overpass in Wailuku to the intersection with Kahului Beach Road and Kane Street on Kahului;

6. Pulehu Road, beginning from its intersection with Hana Highway in Kahlui to its intersection with Hansen Road, and then beginning .6 mile east of Hansen Road to its intersection with the plantation ditch commonly known as Lowrie’s Ditch.

B. Lahaina District.

1. Honoapiilani Highway, from a point .6 mile south of Maalaea Small Boat Harbor Road to a point .6 mile north of the Pali tunnel; thence from a point at the intersection of Honoapiilani Highway and Camp Pecusa Road to a point five hundred feet south of Olowalu Village; thence five hundred feet after leaving said village to the Honokowai Bridge, except as to that section of Honoapiilani Highway from its intersection with Prison Street to its intersection with Kaanapali Parkway;

2. Honoapiilani Highway, from the intersection of Honoapiilani Highway and Lower Honoapiilani Road at Honokowai to the intersection of Honoapiilani Highway with the Lower Honoapiilani Road at Kahana for the Lahaina-bound traffic;

3. Honoapiilani Highway, from the intersection of Honoapiilani Highway and Lower Honoapiilani Road at Honokowai to a point two thousand eight hundred feet from the intersection of Honoapiilani Highway and Lower Honoapiilani Road at Kahana for the Napili-bound traffic;

C. Makawao District.

1. Haleakala Highway, beginning from the Haliimaile junction to the plantation ditch commonly known as Lowrie’s ditch Pukalani;

2. Hana Highway, beginning of the new federal aid highway from Hookipa Park to Huelo;

3. Haiku Road, beginning from Kokomo to Haiku;

4. Kekaulike Avenue, beginning from the intersection of Haleakala Highway and Haleakala Crater Road to the Kealahou Highway intersection;

5. Pulehu Road, beginning from its intersection with the plantation ditch commonly known as Lowrie’s Ditch to its intersection with Omaopio Road in Kula;

6. Kula Highway, from its intersection with Haleakala Highway to the junction of Kekaulike Avenue.

D. Lanai District. Kaumalapau Highway, beginning from a point 1.16 miles west of the Kaupili Road junction to the Manele Road junction.

E. Molokai District.

1. Kamehameha V Highway, beginning from Onealii Park to Kamahuehue Pond in Kamalo.

2. Kamehameha V Highway, beginning of the State highway and Kaunakakai Gulch to a point five hundred feet within the Mauna Loa Village. 10.36.100 Fifty-five mile per hour limit.

No person shall operate a vehicle in excess of fifty-five miles per hour on the following highways or indicated portions thereof:

A. Wailuku District.

1. Honoapiilani Highway, beginning from south of Waikapu town to a point .6 mile south of Maalaea Small Boat Harbor Road;

2. Kuihelani Highway, from its intersection with Puunene Avenue to its intersection with Honoapiilani Highway;

3. Hana Highway, from its intersection with Dairy Road in Kahului to its intersection with Baldwin Park Road in Paia;

4. Haleakala Highway, beginning from the intersection of Hana Highway to the Keahua Road.

B. Lahaina District. Honoapiilani Highway, from a point .6 mile north of the Pali tunnel to a point .3 mile south of its intersection with Camp Pecusa Road.

C. Makawao District.

1. Haleakala Highway, beginning from the Keahua Road intersection to the Haliimaile junction. (Ord. 413.181 § 3, 1984; Ord. 413.92 § 1(c), (d), 1976; Ord. 413.46 § 1(c), 1972: Ord. 413 § 10-7.6A, 1965)

10.36.110 Reduction of speed for special hazards.

The fact that the speed of a vehicle is lower than the prima facie limits set forth in this chapter shall not relieve the operator from the duty to decrease speed when approaching and crossing an intersection, when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway, or when special hazard exists with respect to pedestrians or other traffic or by reason of weather or highway condition, and speed shall be decreased as may be necessary to avoid colliding with any person, vehicle, or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use due care. 10.36.120 Minimum speed regulations.

A. The operator of a slow moving vehicle shall operate the same as close as possible to the right-hand edge of any roadway, whether laned or unlaned for traffic.

B. The operator shall not operate a motor vehicle at such a low speed as to impede or block the normal and reasonable movement of traffic except when so directed by a police officer, or when reduced speed is necessary for safe operation, or in compliance with law.

C. Whenever any roadway clearly provides for two or more lanes, marked or otherwise, of traffic moving in the same direction, every person operating a motor vehicle in the extreme left lane shall travel at the maximum stated speed, except when so directed by a police officer or when a reduced speed is necessary for safe operation, or in compliance with the law.

D. Whenever a speed limit is set at forty-five miles per hour or more, the minimum speed shall be ten miles per hour less than the posted speed limit, and the operator shall not operate his vehicle less than the minimum speed limit except when necessary for safe operation. 10.36.130 Speed contests unlawful.

It shall be unlawful for any person to engage in, or to aid or abet by whatever means, any motor vehicle speed contest or exhibition of speed on any public street or any private street upon which the county has been authorized to impose traffic regulations. Any intentional excessive revving up of engine followed by screeching of tires, jack rabbit or quick starts, whether it be done by one vehicle alone or in connection with another vehicle, shall be illegal.
