Article I. Operating Procedures


10.24.010 Operation on right side of roadway.

Upon all roadways of sufficient width a vehicle shall be operated upon the right half thereof, except as follows:

A. When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement;

B. When the right half of a roadway is closed to traffic while under construction or repair;

C. Upon a roadway divided into three marked lanes for traffic under the rules applicable thereon;

D. Upon a roadway designated and signposted for one-way traffic. (Ord. 413 § 10-9.1, 1965)

10.24.020 Oncoming traffic.

Operators of vehicles proceeding in opposite directions shall pass each other to the right, and upon roadways having width for not more than one line of traffic in each direction, each operator shall give to the other at least one-half of the main travelled portion of the roadway as nearly as possible. 10.24.030 Overtaking vehicles on the left.

A. The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to those limitations, exceptions and special rules stated in this section:

1. The operator of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again operate to the right side of the roadway until safely clear of the overtaken vehicle.

2. The operator of a vehicle, about to be overtaken and passed by another vehicle approaching from the rear, shall give way to the right in favor of the overtaking vehicle, on suitable and audible signal being given by the operator of the overtaking vehicle and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle.

B. No vehicle shall be operated to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direction, unless such left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be made completely without interfering with the safe operation of any vehicle approaching from the opposite direction or any vehicle overtaken. In every event, the overtaking vehicle must return to the right-hand side of the roadway before coming within two hundred feet of any vehicle approaching from the opposite direction.

C. No vehicle shall at any time be operated to the left of the centerline on a roadway under the following conditions:

1. When approaching the crest of a grade or upon a curve in the highway where the driver's view is obstructed within such distance as to create a hazard in the event another vehicle might approach from the opposite direction;

2. When approaching within one hundred feet of or traversing any intersection or railroad grade crossing;

3. When the view is obstructed upon approaching within one hundred feet of any bridge, viaduct, or tunnel;

4. On any roadway marked with a solid double centerline.

D. The limitations set forth in subsection C of this section shall not apply upon a one-way roadway. (Ord. 413 §§ 10-9.3, 10-9.5, 10-9.6, 1965)

10.24.040 Roadways laned for traffic.

Whenever any roadway has been divided into two or more clearly marked lanes for traffic, the following rules in addition to all others consistent herewith shall apply:

A. All vehicles shall be operated as nearly as practical entirely within a single lane and shall not be moved from such lane until the operator has first ascertained that such movement can be made with safety.

B. Upon a roadway which is divided into three lanes, a vehicle shall not be operated in the center lane except when overtaking and passing another vehicle where the roadway is clearly visible and such center lane is clear of traffic within a safe distance, or in preparation for a left turn or where such center lane is at the time allocated exclusively to traffic moving in the direction that the vehicle is proceeding and is designated by official traffic-control devices.

C. Official signs may be erected and/or the pavement marked directing slow-moving traffic to use a designated lane or designating those lanes to be used by traffic moving in a particular direction regardless of the center of the roadway and operators of vehicles shall obey the directions of every such sign and markings.

D. Traffic-control devices may be installed, prohibiting the changing of lanes on sections of roadway, and drivers of vehicles shall obey the directions of every such device. (Ord. 413 § 10-9.8, 1965)

10.24.050 Divided highways.

Whenever any highway has been divided into two or more separate roadways by medial strips, every vehicle shall be driven only upon the right-hand roadway and no vehicle shall be driven over, across, or within any such medial strips except through an opening in such strips or at a crossover or intersection; provided, however, that a driver who enters such opening, crossover, or intersection shall yield the right-of-way to approaching vehicles before emerging upon the adjacent roadway of such divided highway, unless otherwise instructed. 10.24.060 Overtaking vehicles on the right.

A. The operator of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions:

1. When the vehicle overtaken is making or about to make a left turn;

2. Upon a street or highway with unobstructed pavement, not occupied by parked vehicles, of sufficient width, and with lanes marked for two or more lines of moving vehicles in each direction;

3. Upon a one-way street, or upon any roadway on which traffic is restricted to one direction of movement, where the roadway is free from obstructions and of sufficient width of two or more lines of moving vehicles.

B. The operator of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. In no event shall such movement be made by operating off the pavement or main travelled portion of the roadway. (Ord. 413 § 10-9.4, 1965)

10.24.070 No-passing zones.

A. The county engineer or the Maui District Engineer of the Department of Transportation of the state are authorized to determine those portions of any highway where overtaking and passing or operating to the left of the roadway would be especially hazardous, and the engineers may by appropriate signs or markings on the roadway indicate the beginning and end of such zones.

B. Where signs or markings are in place to define a “no-passing zone” as set forth in subsection A of this section, no driver shall at any time drive on the left side of the roadway within such no-passing zone or on the left side of any pavement striping designed to mark such no-passing zone throughout its length. 10.24.080 Following too closely.

A. The operator of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon and the condition of the highway.

B. The operator of any motor truck or motor vehicle drawing another vehicle when travelling upon a roadway outside of a business or residential district and which is following another motor truck or motor vehicle drawing another vehicle shall, whenever conditions permit, leave sufficient space so that an overtaking vehicle may enter and occupy such space without danger, except that this provision shall not prevent a motor truck or motor vehicle drawing another vehicle from overtaking and passing any like vehicle or other vehicle.

C. Motor vehicles being operated upon any roadway outside of a business or residential district in a caravan or motorcade, whether or not towing other vehicles, shall be so operated as to allow sufficient space between each such vehicle or combination of vehicles so as to enable any other vehicle to enter and occupy such space without danger. This provision shall not apply to funeral processions. (Ord. 413 § 10-9.9, 1965)

10.24.090 Signals on starting, stopping and turning.

A. The operator of any vehicle upon a public highway before starting, turning, or stopping such vehicle shall first see that such movement or cessation of movement can be made in safety; then if any pedestrian may be affected by such movement, the operator shall give a clearly audible signal by sounding a horn or other warning device, and whenever the operation of any other vehicle may be affected by this movement, the operator shall give a signal plainly visible to the operator of such other vehicle of the intention to make such movement. Such visual signal may be given either by the use of the hand and arm in the manner provided in this section, or by means of a mechanical or electrical device which meets the requirements set forth in this section, and which has been approved by the chief of police; provided, however, that whenever a hand and arm signal would not be visible both to the front and rear of such vehicle, then such vehicle must be equipped with, and the visual signal must be given by, such a mechanical or electrical device.

B. Whenever the signal is given by means of the hand and arm, the operator shall indicate his intention to turn to the left by extending his hand and arm horizontally from and beyond the left side of the vehicle; his intention to turn to the right by extending his hand and arm upward and beyond the left side of the vehicle; and his intention to stop or to suddenly decrease speed by extending his hand and arm downward from and beyond the left side of the vehicle, showing the palm of the hand to the rear; provided, however, that in a right-hand drive vehicle, the operator shall indicate his intention to turn to the left by extending his hand and arm upward and beyond the right side of the vehicle; his intention to turn to the right by extending his hand and arm horizontally from and beyond the right side of the vehicle; and his intention to stop or to suddenly decrease speed by extending his hand and arm downward from and beyond the right side of the vehicle showing the palm of the hand to the rear.

C. The signal required in this section to be given before turning to the right or left, whether given by means of the hand and arm or by means of a mechanical or electrical device approved by the chief of police shall be given continually during the last one hundred feet travelled by the vehicle before turning. Article II. Turning Movements


10.24.100 Turning at intersections.

A. Both the approach for a right turn, and a right turn shall be made as close as is practicable to the right-hand curb or edge of the roadway.

B. Approach for a left turn shall be made in that portion of the right half of the roadway nearest the centerline thereof, and after entering the intersection, the left turn shall be made so as to leave the intersection to the right of the centerline of the roadway being entered.

C. Approach for a left turn from a two-way street into a one-way street shall be made in that portion of the right half of the roadway nearest the centerline thereof and by passing to the right of such centerline where it enters the intersection. A left turn from a one-way street into a two-way street shall be made by passing to the right of the centerline on the street being entered upon leaving the intersection.

D. Where both streets or roadways are one-way, both the approach for a left turn and a left turn shall be made as close as practicable to the left-hand curb or edge of the roadway.

E. In all cases where official marks, buttons, signs or directional arrows painted on the pavement are placed within or adjacent to intersections, no operator of a vehicle shall execute a movement at such intersections, otherwise than as directed and required by such marks, buttons, signs, or arrows. 10.24.110 Left turns prohibited at certain intersections.

No operator of a motor vehicle shall make a left turn at the following intersections:

A. While travelling west on the road known as Ting's Drive in Wailuku, no left turn into Kaahumanu Avenue to travel east thereon;

B. While travelling west on Kaahumanu Avenue, no left turn to enter Naniloa Drive west of the bridge over Kaahumanu Avenue in Wailuku;

C. While travelling west on E. Main Street in Wailuku, no left turn to enter or cross Kaahumanu Avenue;

D. While travelling west on Kaahumanu Avenue in Wailuku and turning left into Kinipopo Street, no left turn to enter Oihana Street;

E. During week days while travelling south on Papa Avenue, no left turn to enter One Street from seven-fifteen a.m. to eight a.m. and one p.m. to two-thirty p.m.;

F. During school days while travelling south from Front Street, no left turn to enter Prison Street from seven-fifteen a.m. to eight a.m. and one p.m. to two-thirty p.m.;

G. While travelling north on Maalaea Road, no left turn to enter Honoapiilani Highway. (Ord. 413.171 § 1, 1982; Ord. 413.165 § 1, 1981; Ord. 413.128 § 1, 1979; Ord. 413.117 § 1, 1978; Ord. 413.36 § 1, 1971: Ord. 413 § 10-8.5, 1965)

10.24.115 Right turns prohibited at certain intersections.

No operator of a motor vehicle shall make a right turn at the following intersection:

A. While travelling Makai on Baldwin Avenue, no right turn to enter Brewer Road. (Ord. 413.206 § 1, 1987)

10.24.120 Turning on divided highways.

A. Vehicles intending to turn left into the far roadway of a divided highway shall come to a complete stop before crossing the near roadway of such highway, and shall then proceed into the left-turn accelerating lane constructed in the medial strip area, and shall merge with caution into the left-hand lane of the far-roadway, unless otherwise instructed; provided where no accelerating lane exists, such left turn shall be made into the left-hand lane of the far-roadway.

B. Vehicles intending to turn left from a divided highway, exit from which is made by means of a left-turn decelerating lane constructed in the medial strip area, shall enter the decelerating lane and shall yield the right-of-way to approaching vehicles before proceeding with caution across the intersection and into the intersecting roadway, unless otherwise instructed; provided where no decelerating lane exists, such left turn shall be made with caution from the lane nearest the medial strip. 10.24.130 U-turns.

A. No operator shall turn any vehicle so as to proceed in the opposite direction except when it can be done in safety and does not interfere with traffic.

B. In business districts, U-turns shall be made only at intersections and only when it can be done in safety and without interfering with traffic. (Ord. 413 §§ 10-8.3, 10-8.4, 1965)

10.24.140 Obedience to no-turn signs.

Whenever authorized signs are erected indicating that no right or left or “U” turn is permitted, no operator of a vehicle shall disobey the directions of any such sign. (Ord. 413 § 10-8.2, 1965)
