5.08.010 Register required.

A. Every owner, keeper or proprietor of any lodginghouse, roominghouse or hotel shall keep a register wherein he shall require all guests, roomers, or lodgers to inscribe their names upon their procuring of lodging or a room or accommodations. The register shall also show the day of the month and year when the name was inscribed, and the room occupied or to be occupied by the lodger, roomer or guest in such lodginghouse, roominghouse or hotel. The register shall at all times be open to inspection by the chief of police or any police officer or detective of the Maui police department, when required.

B. For the purpose of this chapter, “register” means either a permanently bound blank book, sufficient in size to contain all the information herein required to be placed therein, or a series of individual cards with adequate space on each to enter all the information required by this section. All cards thereafter shall be systematically filed and be open to inspection as provided in subsection A of this section. (Prior code § 22-15.1)

5.08.020 Name required.

Before furnishing any lodging for hire to any person in any lodginghouse, or before renting any room to any person in any roominghouse, or before furnishing any accommodations to any guest at any hotel, the proprietor, manager or owner thereof shall require the person to whom such lodgings are furnished or room is rented, or accommodations furnished, to inscribe his name in such register kept for the purpose as provided in this chapter, and shall set opposite the name the time when the name was so inscribed, and also the room occupied by such lodger, roomer or guest. 5.08.030 Violation--Penalty.

Any person who violates any provision of this chapter shall, upon conviction, be punished by a fine not exceeding twenty-five dollars; provided, however, that a separate offense shall be deemed to have been committed for every day that any person, required by Section 5.08.010 to keep a register, shall fail to keep such register, and for every day that any guest is permitted to remain in any lodginghouse, roominghouse or hotel without being required to register, as required by this chapter.
