Chapter 2.92 TRANSFERS BETWEEN CAPITAL IMPROVEMENT APPROPRIATIONS

2.92.010 Definitions.

Unless otherwise expressly stated, whenever used in this chapter, the following terms shall be taken to have the following meanings:

“Bid” means the amount of money proposed to be charged by a contractor for the construction of a capital improvement project.

“Capital improvement” means a capital improvement identified in the capital program for a fiscal year.

“Capital improvement appropriation” means the amount of money appropriated for the payment of the cost of constructing of a capital improvement.

“Capital improvement appropriation balance” means the unexpended portion of a capital improvement appropriation.

“Council” means the council of the county of Maui. (Ord. 2104 § 1 (part), 1992)

2.92.030 Authorization.

If the bid of the lowest responsible bidder exceeds the amount appropriated for the construction of a capital improvement, the mayor may make transfers from other capital improvement appropriation balances for the same fiscal year; provided, however, such transfers from other capital improvement appropriation balances shall not, in the aggregate, increase or decrease the capital improvement appropriations by more than ten percent, or $25,000, whichever is less. 2.92.030 Reports to council.

Within thirty days after each transfer, the director of finance shall report to the council the amount of the transfer and shall identify the capital improvement appropriation from which and to which transfers have been made. (Ord. 2104 § 1 (part), 1992)
